2. Products

We make every reasonable effort to ensure that product descriptions, specifications, dimensions, photographs and prices displayed on this website are accurate. Product colours may vary slightly from those displayed on screen. Dimensions, weights and specifications may also be subject to reasonable manufacturing tolerances.

We reserve the right to make reasonable changes to product specifications and to correct errors or omissions on the website.

All products are subject to availability.

3. Prices

Prices are shown in Pounds Sterling (£) unless otherwise stated.

Prices will be displayed as inclusive or exclusive of VAT as indicated on the website and during checkout.

Any applicable delivery charges will be displayed during the ordering process where possible.

For orders delivered outside the United Kingdom, customs duties, import taxes or other local charges may apply. Unless otherwise stated, these are the responsibility of the customer.

4. Placing an Order

When you place an order through our website, you are making an offer to purchase the products in your basket.

After submitting an order, you should receive an email acknowledging that we have received it. This acknowledgement does not necessarily constitute acceptance of your order.

A contract is formed when we accept your order and confirm that it is being processed or dispatched.

We reserve the right to refuse or cancel an order where:

* a product is unavailable;
* an incorrect price or product description has been displayed;
* payment cannot be authorised;
* we reasonably suspect fraudulent or unauthorised activity;
* we cannot deliver to the address supplied; or
* there has been an obvious error in the ordering process.

If we cancel an order after payment has been taken, we will refund the amount paid.

5. Payment

Payment must be made using one of the payment methods offered at checkout.

Online card and other electronic payments may be processed securely by Stripe or another payment service provider appointed by us.

Payment information is transmitted securely to the relevant payment provider. We do not ordinarily receive or store your complete payment card details.

Your bank or card statement may display Anchor Marine, Scobie Marine Limited or another descriptor clearly associated with the transaction, depending upon the payment method and payment provider.

Payment must be successfully authorised before an order can be fulfilled.

6. Delivery

Available delivery methods and applicable charges will be displayed during checkout where possible.

We aim to dispatch and deliver orders within the timescales stated on the website or communicated when your order is placed.

Delivery dates and times are estimates unless expressly agreed otherwise.

Some products may be manufactured or prepared to order and may therefore have longer lead times.

Customers are responsible for providing a complete and accurate delivery address. We may charge reasonable additional costs where redelivery is necessary because incorrect or incomplete information has been supplied.

Risk in the goods passes to you when the goods are delivered to you or to a person nominated by you to receive them.

7. International Orders

We may accept orders for delivery outside the United Kingdom where international delivery is offered or agreed separately.

International deliveries may be subject to customs clearance, import duties, taxes and other charges imposed by the destination country.

Unless otherwise stated, these charges are the customer’s responsibility.

Customs procedures may cause delays outside our control.

8. Consumer Cancellation Rights

If you purchase as a consumer, you may have the right to cancel your order under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

For most standard products purchased online, you have 14 days from receiving the goods to tell us that you wish to cancel.

Once you have notified us of your cancellation, you normally have a further 14 days to return the goods.

To cancel an order, contact us at info@anchor-marine.com, providing your name, order number and details of the products concerned.

These cancellation rights are subject to statutory exceptions, including certain personalised and made-to-order products.

9. Returns

Please contact us before returning goods so that we can provide the appropriate return instructions.

Goods should be returned without undue delay and within the applicable return period.

You should take reasonable care of products while they are in your possession.

You may inspect goods in the same way that you reasonably could in a physical shop. Where goods have been handled beyond what is necessary to establish their nature, characteristics and functioning, we may be entitled to make an appropriate deduction from the refund for any reduction in value.

Unless goods are faulty, damaged or incorrectly supplied, you will normally be responsible for the cost of returning them.

10. Personalised, Customised and Made-to-Order Products

Some Anchor Marine products may be manufactured, printed, marked, branded or otherwise customised specifically to your requirements.

The statutory right to cancel an online purchase does not normally apply to goods that are made to the customer’s specifications or are clearly personalised.

This may include products incorporating:

* customer-specified wording or lettering;
* logos or supplied artwork;
* custom branding;
* bespoke markings; or
* other specifications manufactured specifically for an individual customer.

Customers are responsible for checking spelling, dimensions, colours, artwork and other specifications before approving a customised order.

Once production of a bespoke or personalised product has commenced, cancellation or alteration may not be possible.

This does not affect your statutory rights where a customised product is faulty, damaged or does not conform to the agreed specification.

11. Faulty, Damaged or Incorrect Goods

If goods are faulty, damaged when delivered, incorrectly supplied or not as described, please contact us as soon as reasonably possible.

We may ask for photographs or other reasonable information to help us assess the problem.

Depending upon the circumstances and your statutory rights, we may offer a repair, replacement, price reduction or refund.

Nothing in these Terms & Conditions limits or excludes your statutory rights under the Consumer Rights Act 2015 or other applicable consumer legislation.

12. Refunds

Where you are entitled to a refund, we will process it without undue delay and within the timescales required by applicable law.

Refunds will normally be made using the same payment method used for the original transaction.

Once we have issued a refund, the time taken for funds to appear in your account may depend upon your bank, card issuer or payment provider.

Original standard delivery charges will be refunded where required by law.

Additional charges resulting from your choice of an enhanced or premium delivery service may not be refundable where permitted by law.

13. Business Customers

If you purchase products wholly or mainly for purposes relating to your trade, business, craft or profession, you are purchasing as a business customer.

Statutory consumer cancellation rights do not apply to business purchases.

Where separate terms, quotations, purchase agreements or credit arrangements have been agreed in writing between Scobie Marine Limited and a business customer, those terms will take precedence where they conflict with these website Terms & Conditions.

14. Product Use

Marine products should be selected, installed and used appropriately for their intended purpose.

Customers are responsible for ensuring that products are suitable for their intended application, vessel, installation or operating environment unless we have expressly advised otherwise in writing.

Any installation, operating, maintenance and safety instructions supplied with a product should be followed.

Products should not be modified or used for purposes for which they were not designed.

15. Liability

Nothing in these Terms & Conditions excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation.

If you are a consumer, we are responsible for losses that are a foreseeable consequence of our breach of these terms or our failure to use reasonable care and skill.

We are not responsible for losses that were not reasonably foreseeable when the contract was formed.

For business customers, to the extent permitted by law, we will not be liable for indirect or consequential losses, loss of profit, loss of business, loss of revenue, loss of anticipated savings or loss of business opportunity.

Nothing in this section affects rights or remedies that cannot legally be excluded or limited.

16. Events Outside Our Control

We will not be responsible for delays or failures caused by circumstances outside our reasonable control.

These may include severe weather, transport disruption, industrial disputes, interruptions to utilities or communications, customs delays, natural disasters, government action or disruption affecting our suppliers or delivery partners.

Where such circumstances affect an order, we will take reasonable steps to minimise the impact.

17. Website Use

We take reasonable care to ensure that information published on this website is accurate and that the website remains available.

However, we cannot guarantee that the website will always be uninterrupted or error-free.

You must not misuse the website, attempt to gain unauthorised access, introduce malicious software or use the website for any unlawful purpose.

18. Intellectual Property

Unless otherwise stated, the text, photographs, graphics, product information, logos and other content appearing on this website are owned by or licensed to Scobie Marine Limited.

Anchor Marine branding and website content may not be reproduced or used commercially without prior written permission.

19. Customer Artwork and Logos

Where you supply us with a logo, artwork, text or other material for use on a customised product, you confirm that you have the necessary rights and permissions for us to reproduce that material for the purpose of fulfilling your order.

You are responsible for ensuring that material supplied to us does not infringe another person’s intellectual property rights.

20. Privacy and Personal Information

We process personal information in accordance with our Privacy Policy and applicable UK data protection legislation.

Personal information may be used to process orders, take payments, arrange delivery, provide customer service and meet our legal and regulatory obligations.

Payment information may be provided directly to payment processors, including Stripe, for the purpose of processing and protecting transactions.

Please refer to our Privacy Policy for further information about how personal information is collected, used and protected.

21. Fraud Prevention and Security

We may use payment providers and other service providers to help identify and prevent fraudulent transactions.

Orders may be subject to security checks before they are accepted or dispatched.

Where we reasonably suspect fraudulent, unauthorised or unlawful activity, we may delay, refuse or cancel an order.

22. Complaints

If you are unhappy with a product or service supplied by Anchor Marine, please contact us:

Email: info@anchor-marine.com
Tel: +44 (0) 1823 672 555

Please provide your name, order number and sufficient information for us to investigate the matter.

We will make reasonable efforts to resolve complaints promptly and fairly.

23. Changes to These Terms

We may update these Terms & Conditions from time to time to reflect changes to our business, products, website or applicable law.

The Terms & Conditions applicable to an order will normally be those published on the website at the time the order was placed.

24. Severability

If any provision of these Terms & Conditions is found to be unlawful, invalid or unenforceable, the remaining provisions will continue in full force and effect.

25. Governing Law

These Terms & Conditions and contracts formed through this website are governed by the laws of England and Wales.

If you are a consumer resident elsewhere in the United Kingdom, you may also benefit from mandatory rights available under the laws applicable where you live.
